The ‘Hirer’ means the person signing the booking form to hire the equipment’ 
The ‘Supplier’ means The Beverley Events Company.
'Teepee or teepee's refers to indoor-only equipment to deliver teepee sleepover parties.
'Luxe picnics' refers to outdoor based picnic table hire.
‘Bell tent’ refers to equipment designed for outdoor bell tent sleepover parties.
‘Equipment’ refers to tipi’s, bell tents, bounce castles and other equipment specified in the invoice.
'Bounce Castle' or 'Bouncy Castle' refers to white bouncy castle hire.

1.Booking
1.1 A non-refundable deposit and completion of the booking form is required to secure the party date and booking. The booking deposit differs depending on the service. When the Hirer books a party, the Supplier will hold the booking date for 24 hours. The Supplier reserves the right to re-release the date if the deposit is not received within 24 hours.
​
1.2 The remaining balance plus a damage deposit is due a minimum of one week prior to the date of the party. Set-ups will not be undertaken until any balance is paid and if the balance is not paid, the Supplier reserves the right to cancel the party booking. Payment of the deposit and remaining balance is accepted by bank transfer (see bank details below).

1.3 The deposit is refundable once the equipment has been collected, checked for damage and fully tested (up to 48 hours following the event).
​
1.4 For all Luxe Picnic & Bell Tent Parties, final numbers and choices must be confirmed at least 7 days prior to the date of the booking. Any booking reductions after this time will still be charged for at the previous rate, with no refunds due. 
​
1.5 The Hirer is responsible for providing the Supplier with all relevant medical/dietary information for all individuals (including children) attending the party. The Supplier will take no responsibility for allergies (including skin, food, materials etc) if not advised in advance of the condition by the Hirer. The Supplier is likewise, not responsible at any point, for the welfare of the children at the parties, which remains the full responsibility of the hirer.

1.6 The Hirer must ensure the safe use of the Suppliers hire equipment. The Teepee's and Bell Tents are strictly for display purposes and to sleep inside. Under no circumstances should equipment be climbed on or moved once they have been set up. Bunting and lighting can represent a risk of strangulation and children must be supervised at all times when the decoration is displayed.

1.7 The Hirer is responsible for ensuring the accuracy of the information given to the Supplier and to pass over such information in sufficient time to perform the contract safely and without risk, within 14 days of the event occurring to avoid last minute disappointment.
​
 1.11 The Supplier reserves the right to make any changes to the services as is deemed reasonably necessary, without notice to the Hirer. If the required service is less than originally requested, the requisite refunds will be made to the Hirer. 
​
1.8 The Hirer must disclose the property type and details of park & how the property can be accessed at the time of booking the party. In the event that access is limited or difficult it is the Supplier’s discretion whether the booking is accepted.
​
1.9 The Supplier accepts no liability or responsibility if on arrival, it is recognised that the Hirer does not have the necessary permissions/ permits in place for the hire of our goods and services meaning the booking cannot go ahead. No refunds will be given if your booking cannot go ahead because of difficult access / needing permits / permissions which has not been disclosed at the time of booking.

1.10 The Hirer should not attempt to move or pack up equipment supplied by the Supplier. The Supplier accepts no liability or responsibility for accidents or damage which may occur if you choose to assist with carrying our equipment.
​
1.11 The hirer is responsible for ensuring adequate space is available for the equipment. We will not refund in full or in part the monies paid in the event that adequate space is not available to set-up the equipment.
​
i. Tipi Sleepovers - the space required for one tipi is 180cm H x 110cm sq.
ii. Bell Tents - The space required for one Bell Tent including poles and pegs is 6 metres diameter. In addition, the Bell Tent equipment can only be pegged into the ground. We cannot pitch the Bell Tent into astroturf or hard surfaces. If required, we may be able to arrange a site check prior to the party booking. Please be aware the Bell Tent may mark/flatten the grass.
iii. Luxe picnics - the space required for the luxe picnic set up is 3m diameter, however this can vary depending on the number of people attending.
iiii. Bounce Castles - The space required for one bounce castle is 4.5M X 4.3M X 3.6M.

1.12 The supplier reserves the right to make any changes to the services and set-up and collection times as is deemed necessary.
1.19 The Suppliers hire price includes delivery within a the first 5 miles from Beverley, East Yorkshire. Locations further than a mile proximity will incur additional travel fees.
1.13 When hiring the bounce castle, the hirer must ensure the number of users does not exceed that which is outlined in the handover form and booking terms. This is as follows:
There is also a maximum height restriction of 1.8m / 5"9 for adults.
2. Damage
​
2.1 The Hirer is responsible/ liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use of any equipment provided by the Supplier.
​
2.2 It is the Hirers responsibility to ensure that the children are supervised at all times. The Supplier will charge the hirer for the costs of any damage to any property caused by your breach of this clause. 
​
2.3 The Supplier will accept no liability or responsibility to the Hirer for any damages, costs, losses, claims, expenses, demands and proceedings including property of Hirer and their guests, or any consequential loss in these regards. 
​
2.4 All equipment will arrive clean and presentable and must be returned in the same standard. Please ensure footwear is removed and placed into the basket provided for all Bell Tent equipment bookings.
​
2.5 Please ensure that all equipment hired is returned in a clean condition. If we have to take any equipment away to
be clean professionally cleaned before the next hire, a cleaning charge will apply (see charge cost under pricing).

3. Supervision
​
3.1 The Hirer is responsible for the care and safety of all the children. 
​
3.2 The Supplier recommends that the Hirer of the party take contact telephone numbers of the children attending if their parent/guardian is not staying at the same time as clarifying any medical/allergic conditions at least 14 days in advance of the event. 
​
3.3 In the interest of health and hygiene, the Hirer should ensure pets are not allowed in close proximity to the Teepee, Luxe Picnic and Bell Tent hire equipment. Any additional cleaning as a result of access to the equipment by pets may result in an additional charge at the Suppliers discretion.
​
3.4 Strictly no smoking is permitted in close proximity of any equipment.
 
3.5 All users of the bounce castle should be supervised at all times.
​
4. Cancellation: (by the Hirer)
In the unfortunate event the party is cancelled the following refund policy will be applied: 
​
4.1 Cancellation of the party will forfeit the deposit paid.
​
4.2 If cancelled in less than 7 days, the Hirer is responsible for paying the remaining balance of the party.
​
4.3 In unavoidable circumstances and only at the discretion of the Supplier, may the deposit be returned to the client and null balance payment required. This will be issued in writing by the Supplier.
 
5. Cancellation (by the Supplier) 
​
5.1 The Supplier reserves the right to cancel the booking at any time for any reason and will try to give as much notice as possible.
5.2 Upon any such cancellation the Supplier will refund to the Hirer any monies paid to the Supplier in respect of the booking. However, the Supplier will not be liable to pay any compensation to the Hirer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation.

5.3 The Supplier reserves the right to terminate the booking without notice if there is a breach of these conditions.
 
5.4 In the event of extreme or adverse weather conditions making it difficult to erect the bell Tent or luxe picnic equipment, the Supplier will not accept any responsibility or liability for losses or other costs incurred as a result. In this situation the Supplier will work with you to offer you and alternative site/date, where possible.

5.5 The bounce castle may only be hired under the strict weather conditions. If windy or raining, the booking may be cancelled at the Hirer's discretion due to health and safety concerns. As an alternative, we can set up the boucey castle indoors.
6. Liability 
​
6.1 Nothing in these terms shall limit or exclude the liability of the Supplier, which may not be limited or excluded by law, including without limitation liability for death or personal injury caused by the Supplier negligence or fraudulent misrepresentation. 
​
6.2 Subject to the above, the Supplier shall have no liability (whether arising under contract, tort, or for breach of statutory duty or otherwise) to the extent that such liability would not have arisen but for the Hirer’s breach of the contract. 
​
6.3 Subject to the above clauses the Supplier aggregate liability for all claims in relation to the contract (whether arising under contract, tort, or for breach of statutory duty or otherwise) shall not exceed the price paid by the Hirer. 
​
6.4 This contract is governed and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England. 
​
6.5 No information included in this booking form will be disclosed to any third party.
 
6.6 This information is given for the safety of all people attending a party hosted by us. It is the sole responsibility of the Hirer to ensure that they are understood and adhered to by all party guests invited.
7. Health & Safety
​
7.1 The Supplier’s Tipis tents and canopies are independently tested and marked CE in accordance with the Toy Safety Regulations UK 2011.
​
7.2 The bounce castle is manufactured in the UK therefore compliant with all UK health and safety regulations. The PVC used complies with flamability requirements of BS586:1980 Part 2 Type B as required. The bounce castle has also been tested to PIPA Standards and the Hirer obtains a PIPA Inspection report (BSEN 14960 2019), logbook and operating instructions.

7.3 The Supplier uses high quality products and follows strict hygiene routines. 
 
7.4 All persons using the Supplier’s equipment do so at their own risk and it is the party hirer who is responsible / liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use. Liability cannot be taken for reactions or injury sustained whilst attending a party or thereafter.

7.5 This information is given for the safety of all people attending a party hired from The Supplier and it is the sole responsibility of the Hirer to ensure that they are understood and adhered to by all party guests invited. 
​
7.6 Any inadvertent delay, omission, or error in complying with the terms and conditions of this Contract shall not be held to relieve either party hereto from any liability, which would attach to it hereunder if such delay, omission, or error had not been made, provided such delay, omission, or error is rectified upon discovery.
​
7.7 The Supplier shall use all reasonable endeavours to provide the services in accordance with the contract and shall perform the services with reasonable skill, care and diligence and in accordance with all health and safety regulations in force at this time. 
​
7.8 The Hirer should be aware that guy ropes are a potential trip hazard therefore care should be taken when entering and exiting the Bell Tent.
​
7.9 It is the Hirer’s responsibility to ensure the following rules are adhered to inside all Bell Tent and Tipi equipment
​
i. Smoking is strictly prohibited within proximity and inside all equipment. If any equipment is returned smelling of smoke, a cleaning charge will be incurred.
ii. For your protection and safety, no naked flames are to be used inside all equipment such as candles, open fires, gas fire or other sources of flammable substances. Battery operated candles will be provided.
iii. No food, drinks or chewing gum to be allowed on or near the Bounce castle which will avoid choking
iiii. No shoes, glasses, jewellery, badges MUST be removed before using the Bounce castle. Strictly no face paints, party poppers, coloured streamers or silly string to be used either on or near the bounce castle.
ii. For your protection and safety, no naked flames are to be used inside all equipment such as candles, open fires, gas fire or other sources of flammable substances. Battery operated candles will be provided.

8. Other
​
8.1 The Supplier has suitable public liability insurance and takes the upmost care to ensure the safety of all party guests at all times. The Supplier can provide certification if required.
​
8.2 The Supplier shall process all data in accordance with the Data Protection Act 2018 which include the new rules on GDPR. 
​
8.3 Some produce used may contain traces of nuts or may have been made in a factory that handles nuts. Please carefully check all ingredients before use/application. 
​
8.4 It is not the intention of the Supplier to violate any copyright laws and all themes are only inspired by popular trends. 
​
8.5 The Supplier is unable to accept bookings from anyone under 18 years of age.
​
8.6 In the event the Hirer choses a simple equipment hire only package (no decorations / bedding provided), the Hirer must consider ensuring clear paths to exit in the event of an emergency.
​
8.7 The Hirer confirms they will always adviser the Supplier if anyone within proximity of the equipment tests positive for Coronavirus or displays symptoms. It is also the Hirer’s responsibility to adhere and manage social distancing and other government guidelines.
